Abstract


As an important subject of the natural environment, terrestrial forest ecosystems which has ecological value, economic value, spiritual value, social value and other aspects of value, constitutes the natural environment. In order to protect the sustainable use of forest resources and maintain ecological balance of forests, China has set up many property law legal systems of forest resources, including" The People’s Republic of China Constitution", "Property Law", The People’s Republic of China Forest Law", "The People’s Republic of China Forest Law Enforcement Ordinance".In recent years, state forestry and forest resources have undergone tremendous changes. The legal system of property rights of forest resources has taken on legislative delay, confusion and many other problems. It can not adapt to new circumstances. Improve the legal system of property rights of forest resources and promote the use of forest resources have become the first task, while the protection and development are burning. This paper describes the content and system of the legal system of forest resources, meanwhile it also analysis’s the problems in the law. Last but not least, the paper also discussed ways of the law’s improvement and development in order to perfect the legal system of forest resources and benefit the property.The paper, in terms of the structure, is divided into three parts. Chapter one is the introduction of the property rights of forest resources, but especially concerns on the forests, forests resources and property rights of forest resources. ChapterⅡis about the basic system of property.rights for forest resources, according to the classification of property rights, property law combined with forest resources, forest resources were introduced system of property ownership, usufruct system, a security interest in property rights system and the system of transfer of forest resources; ChapterⅢcentered on Right of forest resources and the legal system of the perfect. It sums up the general legal system of property rights of forest resources on the basis of the problem. It also advanced improvements suggestions on the behalf of perfecting legal system of forest resources, regulating the legislative technique, making a clear title to the main body, improving property power, and improving the property rights transfer system, as well the implementation of forest classification management system, improvement of ecological compensation system point of view of forest resources such as Property System recommendations are also included.
