Abstract


The rural homestead right to use our unique an independent usufructuary , residents of rural collective economic organizations legally obtained homestead on the construction of the house and its ancillary facilities , and homestead possession , use and limitations rights of action. Urbanization development has attracted a large number of the rural labor force , resulting in a large number of the rural homestead idle , and rural residential land use rights for a certain number of private transfer , which also exposed to many social problems , and legal issues . Country on how to protect the land , to safeguard the interests of farmers , the construction of a harmonious rural residential land use rights transfer system has become an urgent problem . This paper is divided into four parts : the first chapter of the concept and characteristics of rural residential land use rights , and analyze property attributes . The second chapter is the introduction of laws and regulations , policies and doctrines . The third chapter is an analysis of the Homestead Right feasibility reason , mainly divided into two parts : First , the validity of the buying and selling homes in rural areas described ; Second , the homestead is classified as non-agricultural construction land circulation . The fourth chapter discusses the system of rural residential land use right transfer mode and content of the study , and describes the author point of view .
