Abstract


Last ten years saw an increase in duty crimes and views on how to manage and reform duty criminals. The practice of management and reformation, however, is still in the exploration phase. Today our country is in a critical period, the international situation being complex and volatile and internal conflicts crowding together. In order to improve the Party conduct and build a clean government, improve the system’s ability to resist corruption and withstand risks and reinforce the Party’s leadership and ruling position, we must enhance the management, education and reformation of duty criminals. Compared with other types of criminals, duty criminals have their own characteristics. Generally they are older and weaker, with higher education level, more rights-awareness and more complex social background. These factors might disturb some aspects of the prison management, such as usual visiting and stuff delivery. And they might trouble commutation and parole as well. Hence besides punishment and supervision on duty criminals, prisons must summarize basic experiences and orderliness of reforming duty criminals from the perspective of actual needs to enhance the management, education and reformation of duty criminals, forming the mutual promotion and interpenetration among the punishment and supervision, the reformation-through-labor and the reformation-through-education.On the basis of academic publication of some experts and scholars and my own work practice of prison management, I put my research on this issue into four chapters. The first chapter analyzes the general, psychological, and reformation characteristics of duty criminals. The second chapter analyzes status quo of reformation of duty criminals and summarizes the experiences and orderliness of managing and reforming duty criminals. Chiefly from the aspects of separate escorting and management, reformation-through-labor and reformation-through-education and the supervision on law enforcement, the third chapter analyzes current major problems in the management and reformation of duty criminals and concludes the experiences and lessons on the issue. The last chapter discusses how to reinforce the management and reformation of duty criminals and puts forward some solution proposals.
