Abstract

China is in a period of social transition, the complex social and economic affairs, the government rapidly changing management environment, the the government permanent establishment is often difficult to deal with the public affairs of the new situation and new problems. In order to better deal with the social and economic affairs to fulfill the functions of the government, at all levels of government, often through authorized the establishment of a government temporary agencies to deal with a temporary, emergency, sudden or stage of social and economic affairs. However, some local governments used to set up a temporary body to complete a specialized work, caused by the large number of government temporary agencies, complex nominal, wide range of functions, which seriously affect and interfere with the play of the functions of the government and administration according to law powers. Therefore, it is very necessary standardized management, the establishment of the provisional institutions of government and improve our government oversight mechanisms of the Provisional Institutions. Government Provisional Institutions authorized administrative body, this paper expounded the theory of administrative supervision on the basis of analysis of the problems of supervision and management of the provisional institutions of our government to learn from the experience of foreign government supervision and administration of the Provisional Institutions to explore the building of the provisional institutions of our government administrative oversight mechanisms countermeasures. Establish and improve the mechanism of supervision of the provisional institutions of our government must be included in the government supervision and administration of the Provisional Institutions of administrative supervision system, build a provisional government agencies external oversight mechanisms and internal oversight mechanisms. This paper argues that to improve the oversight mechanisms of the provisional institutions of our government countermeasures are mainly the following aspects: First, the transformation of government functions, the boundary of the clear role of the Provisional Institutions. Supervision and management of the provisional institutions of government, should be established based on reasonable definition of the range of government functions, the executive powers not struggle for power with the market, does not compete with the public benefit, to encourage non-governmental organizations to participate in the public administration, the implementation of government procurement of services, a significant reduce the size of government administrative bodies, to strengthen cooperation with non-governmental organizations, NGO experience and expertise to solve the the temporary complex problem, and without purpose to establish a permanent or temporary agencies. According to the actual need to set up the provisional institutions of the government, and reasonable definition of the responsibility and authority, the Provisional Institutions to fully play its positive role in the government functions within. Secondly, to speed up the legislative process, and improve external oversight of the Provisional Institutions. Improve the supervision and administration of laws and regulations of the government and the Provisional Institutions, a clear set of conditions and procedures of the Provisional Institutions, and specification of the provisional institutions of the terms of reference and operating mechanism to clear the end of the provisional institutions of the conditions and procedures, the Provisional Institutions settings must be scientific proof and strict approval may be established from time to set up , and generally should not be established by existing institutions of its functions to fulfill, and resolutely put an end to the arbitrariness of setting up a temporary body. In the absence of the overlapping functions and management functions need to set up the Provisional Institutions, the first consideration to determine the main coordination functions of the sector and in related or similar functions to increase in the absence of management functions within government agencies. Really can not solve the problem rather than the establishment of a provisional institutions not, must have a clear set of conditions and procedures. Provisional Institutions of government oversight to do a legal basis to guide the political parties, social organizations, the news media and individual citizens, the right to determine in accordance with the Constitution and laws of the Provisional Institutions of supervision and control, the right to restrict power, the establishment of government external democratic evaluation external petition, public opinion and power constraints combined oversight mechanisms. Again, to regulate the internal management, improve internal oversight of the Provisional Institutions.
