The hearing system takes in the modernization process the democratic one kind to realize the form, has legislated, domains and so on administration in our country, judicature to emerge quietly. The administrative hearing system is refers to the administrative main body before to making the influence administration opposite party legitimate rights and interests the decision, constitutes one kind of legal regime by the hearing opposite party opinion’s procedure. The administrative hearing procedure’s establishment, regarding safeguards citizen’s to have the very vital significance in participation social life administrative right. Our country promulgated the implementation in 1996 "the People’s Republic of China Administrative sanctions Law", first time has stipulated the administrative hearing system. Afterward the price method and the legislative law further expanded the hearing system’s content, enabled it to obtain in our country has further developed and consummates. In July, 2004 implemented the administrative permission law, was our country hearing system legislation another tremendous progress.Although the administrative hearing system already obtained the considerable development in our country, but compares with the overseas related system, our country’s hearing system was only just started, regardless in reality were very theoretically imperfect. Our country only then solves the administrative hearing scope to be excessively narrow, the main body system not perfectly, the public degree not high, the hearing record not to have questions and so on legal effect, can play the administrative hearing system’s positive role earnestly, quicker advances our country’s administrative government by law advancement.
