Abstract


Prison sentence is a national enforcement authorities , and shall enjoy the right to investigate . In recent years, though constantly establish and improve China's legal system , the rule of law concept has depth practice , revised Criminal Procedure Law also implemented , but I still feel deeply : Criminal Procedure Law of the provisions of the prison authorities comparative investigation principles and vague, the relevant judicial interpretation is not clear , and some even conflicting , leading provincial prison authorities in their own understanding of the relevant laws and regulations to carry out the investigation , law enforcement is not uniform, serious damage to the majesty of the law . In this regard , the author attempts to combine the criminal investigation and the investigation of the basic theory of the prison authorities , and through the investigation of foreign prison authorities inspect and better explain our rights and prison authorities for investigative defect detection measures and implementation of the legislative status quo , and then put forward a sound investigation of prison authorities concept , on the one hand actively being revised Criminal Procedure Law of the existing offer advice and suggestions on the other hand to solve practical problems in the investigation prison authorities to provide more ideas and information.
