Abstract


The system of relative is a waiver of the right of public prosecution , in essence, given the discretion of the prosecutor in the review activities , it applies to affect the flow of the litigation and entities processing . In China, there are some mistakes and unreasonable deviations with the implementation , as well as in judicial practice in the settings of the system itself , its intrinsic value can not be fully realized. Learn Chinese and foreign institutional research not to prosecute on the basis of the lack of legislation on China superficial analysis of judicial practice in the use of the system to do a preliminary summarized and put forward their own views , to further improve the system of relative to play a greater role in maintaining social stability and protect the legitimate rights and interests of citizens and the efficiency of the proceedings of the system .
