Abstract


Restorative justice is a contemporary Western society to actively promote a new type of processing criminal justice model . Correspondingly, it is intended to compensate for retributive justice inherent defects , repair criminal destruction of social relations as the goal of justice mode and retributive justice . Restorative justice as a crime problems, a new perspective on the theory and practice of China 's criminal justice has a major reference . The fourth plenary meeting of the Central Committee of the Communist Party of China for the first time explicitly asked for \The ideal goal of a harmonious socialist society conflict resolution - fairness , efficiency , autonomy , and the intrinsic value of restorative justice - justice is the same. From the origins of restorative justice about the concept of restorative justice , the theoretical basis of restorative justice were discussed from the constitutional theory and the theory of procedural justice , and also investigated the presence of foreign several restorative justice practice models in the build of the necessity and feasibility of restorative justice based on the proposed China to build the principles of restorative justice system , the applicable conditions and scope of our country from the prevention of crime before the prosecution to detect stage, trial phase and prison terms for the restorative measures of restorative justice system is designed .
