Abstract


In the 21st century, the humanity are facing many environment issues,for example:the land resources dries up,the population suddenly inflates, the environment worsens day by day and so on,.people proposed marching to the sea, and the marine environment value is becoming more and more important.. The marine environment is the human survival environment regulator and human society’s propeller, and has the enormous ecology value and economic value. Therefore, protecting the sea guarantees the humanity development.But following the ocean developing, the marine environment pollution is also serious day by day.And it has already affected the value of marine environment. The marine environment is different from the land environment. we must put the prevention on first and put the prevention and the government together to protect marine environment.In fact, marine environment protection plan is a scientific policy-making activity to overcome the blind and the subjective at will in the ocean development.,and also is the arrangement of the national or the coast local government in the certain time which makes regarding the marine environment protection goal and the measure. In view of the fact that the marine environment particularity, the marine environment protection plan becomes the essential way to prevent and control marine environment pollution in ocean development. But our country marine environment protection plan work just started, comparing with the developed country, the theory and the practice are not all mature, has some legal matters, needed further thoroughly to study.This article multianalysed the necessity of the marine environment protection plan; Introduced the elementary theory: the production and development of marine environment protection plan matters, marine environment protection plan characteristic,principle, rationale as well as main contents; In detail introduced marine environment protection plan related situation about US,England, France, Japan, South Korea and Australia and so on; Has analyzed the related legal rule and the plan situation with emphasis about marine environment protection plan of our country; Finally proposed the suggestion to consummate the legal matter of marine environment protection plan.Consummating the legislation of marine environment protection plan, the perfect legislation enable the plan to have the law to depend on and effectively coordinate the relations of the various benefits; Specify duties of regional marine protection plan regulated by regional marine bureaus to deal with problems of regional marine environment effectively;Guaranteed the public participation in the marine environment protection plan, guaranteed the democratization of decision-making,to make the plan to be feasible; Valued the plan environmental assessment, when carring on the region ocean development, also must carry on the region environmental assessment, formulates the region sea environmental protection plan, to realize the sustainable development.The 21st century is the sea century.In order to use the sea reasonably and protect marine environment value,it is very urgent to formulate the marine environment protection plan. Therefore,establishing the marine environment protection plan theory system, consummating the marine environment protection plan law system, enable the marine environment protection plan to drive into the speedway,guarantees the sea economy into sustainable development.
