Abstract


With the globalization of economy and the development of financil industry in China, financil holding companies have been arisen and developed very fast in China. The development of the financil holding companies have brought a lot of intra-group transanctions. Intra-group transactions bring good and bad effects. While they bring economy of scale and synergetic effect to financil holding companies, they bring risk diffusion and risk contagion. Intra-group transactions should be regulated legally in order to develop the financil industry and make the financil industry safe in China. This dissertation focuses on the legal regulation of intra-transactions and it consists of four parts. The first part discusses the basic theories of intra-group transactions, including its definition, and the necessity to regulate it. The second part introduces the present situation and problems of the legal regulation for intra-group transctions of financail holding companies in China. And the experiences can help to regulate the intra-group transactions in China. The third part introduces the regulative legal system of other countries and other districts applying comparative research methods. The author points out what can use for reference from the experiences of other countries and other districts. The fourth part mentions to establish the legal regulation system for intra-group transactions of financial holding companies in China for reference from the experiences of our country, other countries and other districts.
