Abstract


Known as \Especially in today, the speed and scale of the development of science and technology, shocked the world, and it is affecting people's lives and social development in a new way, which is the world of science and technology strategy Contemporary reason lies. The law, as one of the positive results of the development of human civilization, as an important part of the superstructure of human society, is necessary to promote the development of the social order of factors, is also an important means to preserve the peace and development of mankind. From a philosophical point of view, the core elements of the science and technology as a productivity determines the economic base of the community as a whole, the law as an important social superstructure, and science and technology is bound to produce between interdependence and mutual influence, mutual penetration of contact and interaction . Specifically, the law as \adjustment. Especially in a period of rapid development of today's technology, the social problems caused by the technology greatly increased, and the adjustment range of the law from the social sphere expanded to other areas of the relationship between them is showing more and more closely the trend. This article aims at both the technology and the legal relationship between the hierarchical division focused parsing and elaboration of jurisprudence. The article is divided into four parts, first a brief introduction to the meaning of science and technology and related concepts, the meaning of the law and its emergence and development, and thus the general relationship of the technology and the law made a macro overview. From a value perspective, the second part discusses the technology and fit with the common law, and expounded the science and technology of this impact and the role of specific value from the purpose of the law and the form of value, respectively. The third part focuses on the science and technology for the impact on legal methodology and penetration, respectively, were demonstrated from the two aspects of legal research methods and legal run method. The last part of the content from the practice of our technology development and legal system construction of the departure, on the basis of analysis of our technology legal system development status quo and further proposed the promotion of scientific and technological progress and the rule of law development of realistic countermeasures, in order to provide some reference of our future technology legal system construction . Law and technology relationship between the two, has an important significance. From the theoretical point of view, the study of law not only to stay on in depth analysis of the legal internal problems at the same time, but also to grasp the relationship between law and other social factors, social phenomenon, which is consistent with the sociology of law research ideas, in particular, is an essential part of jurisprudence. From a practical point of view, in the process of promoting technological development and improve the level of legal construction, and always correctly grasp the dialectical relationship between technology and the law, and thus to respect the laws of science and advocating good atmosphere in the whole society, and promote the development of human civilization, technological and rejuvenating with the requirements of statecraft in accordance with the law, in line with the reality of today's social development needs. Therefore, this issue research, both the discipline construction of jurisprudence, or to meet the practical needs of the legal system construction, and thus promote the development of science and technology law, has an important significance.
