Abstract


Not taking any articles left by others is considered as a social phenomenon in times of peace and prosperity. However, people’s understanding of this phrase is not deep. From the perspective of the history of law, this thesis deals with this phenomenon and interprets the relationship between phenomenon and law in ancient periods. This paper divides the laws which are relevant to not taking any articles left by others into good laws and cruel laws. Cruel laws brutally suppress people’s rebellions, which leads to not taking any articles left by others. Compared with cruel law, good laws value the virtues of Confucianism and cultivation, which leads to the improvement of people’s morality. Either case leads to not taking any articles left by others. However, if someone picks up an article left by others, he would be criticized by his own conscience. Besides, according to the laws of Tang Dynasty and Han Dynasty, the interests of those who take the articles left by others are not protected. In either case, the rulers aimed to make people not take any articles left by others.In the first part of this thesis, about historical records and descriptions related to not taking any articles left by others, collections and comments are made. In the second part of this thesis, the laws of not taking any articles left by others are interpreted. From good laws and cruel laws, this paper aims to show that this phenomenon originated from severe punishment towards those who take others’article. This paper explains the reasons of not taking any articles left by others. In good laws, moral education in Confucianism has a close connection with not taking any articles left by others. Good laws give an impetus to the appearance of the phenomenon. The phenomenon helps to formulate and improve good laws. In Ming and Qing Dynasty, there were laws which gave awards to good people, which shows that the phenomenon greatly influences the value system of good laws. In the third part of this thesis, comments about the connection between not taking any articles left by others and law are made. Chinese ancient laws about not taking any articles left by others can give some enlightenment to today’s legislation.
