Abstract


In the system of market economy, consumer is the most active market main body, meanwhile consumers vulnerable position also have become increasingly prominent, consumers are not salvage phenomenon common occurance infringement, this will give the economic development process brings disharmonious factors, hinder economic health development. But in many foreign countries of legislation aimed at this phenomenon has stipulated the tend to consumer party special protection of consumers back right, it allows consumers conditional back and not liable for breach of contract. This paper, starting from the concept of consumer back right, historical origin, legal basis, and similar concept in such aspects as the author, according to foreign advanced legislative experience and combining with the actual situation in our country to consumer back rights for further research.Through the study of consumer back right essence, deep looking for consumers back right through the legal basis, produced in the present stage of legislative situation analysis, specific consumption of construction in our country are discussed the necessity of consumer back right system, and combined with our country’s legislation and judicial practice, puts forward the previous experience of consumer back right system perfect, hoping for a specific method perfect relevant legislation help, to protect the lawful rights and interests of consumers to promote the country’s economy market further the healthy and orderly development.
