Abstract


The extraterritorial application of anti-monopoly law is the inevitable result of the liberalization of world trade. Although the extraterritorial application of anti-monopoly law was faced conflicts and contradictions from the day of its production, now in the world most of the countries or regions established the system of the extraterritorial application to control the international monopoly to protect the development of domestic market healthy and orderly. The system of the extraterritorial application of anti-monopoly law is the most perfect in the US and European union. The extraterritorial application of anti-monopoly law of China has just started, scarced comparatively in judicial practice and has not yet established the relevant specific system, which was the hot issue in the Jurisprudence and judicial practice. On the basis of researching the legislation and judicial practice of the extraterritorial application of anti-monopoly law of the Europe and other developed countries, it was a pressing issue to improve the system and implementation rules of extraterritorial application as soon as possible in China which can achieve the Legislative purpose of anti-monopoly law, truly display its standard market competition behavior and protect the legitimate benefit of our country enterprise.
