Abstract


Administrative appeal plays a vital role for the protection of our legal administrative proceedings. However, there are still some shortcomings in Administrative appea, the current legal provisions on administrative appeal is just an abstract principle, and seriously affected the prosecution of legal supervision functions, such as the Governor of China’s current administrative appeal has been limited to effective administrative judge filed a protest, this post-supervision way can not effectively prevent and stop illegal administrative acts and actions illegal, to a certain extent, affected the function of legal supervision of the full play. Therefore, we must further improve the existing system of administrative appeal. This article researches the basic theory of administrative appeal, and discusses the legal changes of administrative appeal, the problems of this system. On the basis of the relevant legal system, this article protest put forward some thoughts and suggestions on how to improve our administrative system.
