Abstract


How to achieve both to protect the interests of the victim and the offender reversion has become a major issue facing contemporary criminal justice reform . 1970s , the Western developed countries under the rule of law on the basis of reflection and criticism are many disadvantages of the traditional criminal justice system , the formation and development of a new dispute resolution mode , the criminal reconciliation . As a new type of crime handler , the criminal reconciliation stressed the treatment of a result of the criminal conduct of the victim , the defendant and community trauma, recovery the original harmonious social relations and order , reflecting the law \In the West, the criminal settlement system has more than 30 years of successful practice , but China's academic circles for the study of the theory is still in the exploratory stage, the criminal reconciliation around the judicial practice limited to small - scale . This paper aims to research on the theory of criminal reconciliation system and in-depth analysis of the the reconciliation status quo of China 's criminal , to explore an effective way to achieve the localization of criminal reconciliation , in order to better achieve their legitimate and reasonable solution to the function of the criminal offense . Ideas of this research is roughly : first an overview of the criminal settlement , stating what is criminal reconciliation ; Second, the criminal reconciliation in China considerations, analysis of China 's Criminal Reconciliation builds on the theory and judicial practice, the status quo and problems reveal the feasibility and problems of our country to build a criminal reconciliation ; Finally, attempts have focused on the construction of the Criminal reconciliation System make specific recommendations to its start a discussion .
