Abstract


The burden of proof in criminal proceedings is the core based on the presumption of innocence , the criminal in principle, bear the burden of proof by the prosecution , but from contemporary country to combat serious crime , improve litigation efficiency, reduce litigation costs and the realization of the fact that criminal proceedings found , the purpose of starting to establish the truth , are required in some special cases, the prosecution needs to bear some burden of proof . This paper examines the world's major countries in the prosecution the burden of proof in criminal legislation and practices as well as our existing legal framework for criminal prosecution to the burden of proof on the prosecution of criminal Perfection bear the burden of proof suggestions and ideas.
