The basic strategy of governing the country according to law in the Second Session of the Ninth National People's Congress on the way of a constitutional amendment to load the \milestone towards the rule of law and management. Currently, the countries in the world regard the cultivation of high-quality team, optimize the structure of the civil service capacity, enhance the international competitiveness of the government as an important issue and a priority to actively respond. Civil servants administrative capacity is one of the civil servants have the basic ability. Many of the provisions of the Constitution and the laws, regulations mainly rely on the executive and the national civil service to implement the execution of civil servants as the main administrative act, the use of executive power, most often, the most extensive and closely related to the social and public interests and individual citizens interests, reflecting the nature of state power, affecting the party and the government's relationship with the broad masses of the people. Civil Service administrative capacity-building in accordance with the law, whether related to the party's ability to govern in the effective implementation of the national administrative system. A hot topic in recent years, the administrative capacity of the civil servants as a civil servant administrative capacity building much attention. However, some civil servants administrative capacity is weak, affect the normal conduct of administration according to law. So, in the context of the times of strengthening the Party's governance capability and building a socialist harmonious society, continuously push forward the development of the socialist market economic system and deepen the process of government structural reform, we must strengthen the administrative capacity building of civil servants on the strategy height be a careful study and discussion. In this paper, through research, from China's civil service administration according to law capacity status and problems start in the elaborate civil servants administrative capacity-building objectives in accordance with the law on the basis of, proposed to strengthen the civil service training administration according to law, to improve the management of the civil service system, improve the civil service, especially leading law decision-making capacity. Finally, the suggestions proposed to strengthen the civil service administration according to law capacity building, make some exploratory research to advance China's civil service capacity building.
