Abstract


With China's accession to the WTO to speed up the process, a large amount of foreign capital into our country. Foreign investment treatment problems in international investment field has important significance, but also the international investment law a core problem, and one of the national treatment is especially remarkable. This paper tries to international direct investment of national treatment standard problem is discussed from three aspects, firstly, national treatment standard of the legal meaning, scope, and its basic contents and through an analysis of international direct investment and the fair treatment, most favored nation standard of comparison that national treatment standard is applicable to foreign countries within and between the foreign discrimination, to a treatment system. Then through the WTO national treatment of the specific provisions of the analysis shows that the developed countries in the world today, between developed countries and developing countries, between between developing countries applicable national treatment standard general principle, to China's national treatment standards provide reference for improvement. Finally, according to China national law, the provisions of the bilateral investment protection agreement, this national treatment in China is the current situation and problems, and how economic development situation today from the legal Angle perfect national treatment system proposed own shallow Suggestions.
