Abstract


Based on historical document and the foundation of others’research, combining literal materials, this thesis is intended to discuss systematically the background and names of Kanggao in Shangshu,the several issues about its research,the ideas of "bright virture and prudent punishment" and its influence in the following years ,and the ideas and the system of law in Kanggao. The whole thesis is divided into five parts.The first part of this dissertation is the introduction,which gives an outline of Shangshu·Kanggao and makes a simple comment about the outcome and problems existed in the previous research on the Kanggao. This part points out the significance of this thesis topic,and also makes clear its research methods and creation.In the second part,this part makes research on the period of works and the name of Kanggao. On the bases of previous studies,the present author thinks that Kanggao should be the imperial decree by Duke of Zhou in the period of Cheng king when he made Kangshu settled down in the fief named Wei,by observing and studying separately about the views of Cheng king and Wu king. The present author also thinks that Kang should be a place name by making detailed investigation on the two versions: Kang as a name after death and Kang as a place name,and further analyzes the location of Kang.The third part investigates several issues in the study of Kanggao By making use of document and archaeology datas,the present author makes a comprehensive investigation on forty-eight false bamboo slips at the beginning of Kanggao charpter,the problems of "king said as follows"and the relationship between Jiugao and Zicai,accordingly makes a conclusion that the forty-eight words should be false,the king of "king said as follows"should be Duke of Zhou, and Kanggao、Jiugao and Zicai should be the same charpter.In the fourth part,according to the formation、connotation of "bright virture and prudent punishment",the present author disserts specifically the ideas of "worshiping heaven and loving people" at the beginning of Zhou dynasty and the connotation about "virture",the present author also makes a deep analysis about the significance of Confucianism owing to "bright virture and prudent punishment".The fifth part makes research on the ideas and the system of law in Kanggao. By careful reading the charpter and deep analyzing historical document,this thesis disserts thoroughly the ideas and the system of Kanggao and thinks that the system of law has a profound and lasting influence on generations,this thesis also puts forwad that the establishment of legal system in Kanggao is based on absolute monarch,but it embodies the advanced of times for preserving the benifience of the people.
