Abstract


With the liberalization of international trade is now the development of parallel imports, especially the issue of parallel importation has become the trademark of international trade and intellectual property a very hot topic. Parallel imports, in particular, is a trademark of parallel imports, not just the area of intellectual property protection issues, or international trade issues need to be addressed; its nature is not just a legal problem, or a country’s external trade policy issues. However, due to the pursuit of national interests and economic development are different, so even though countries in the world to study and explore this issue and the practice has a hundred years, but still not formed a unified understanding, but there is no clear solution to a very uniform program.Look at our situation, our country after years of difficult negotiations finally joined the WTO in 2001, which means that our future international trade will more frequently, the fact that indeed the case, entry into the WTO, along with the continuous development of China’s market economy, China’s trade with the rest of the world more and more special is a trademark of parallel importation of parallel imports will inevitably become our country is to face one of the most intractable problems.In this paper, parallel importation of trade mark in all aspects of the detailed analysis. Full four chapters.The first chapter is an overview of parallel importation of trade mark, including the concept of parallel importation of trade mark, character, expression, causes, impact and the associated theory point of view, the chapter is the significance of the existence of research and for the next of providing a solid theoretical basis. The second chapter is on some major international and regional countries and the international Convention on the parallel importation of trade mark measures taken to deal with a comprehensive and detailed analysis, with its basis in this country on the mark for the Regulation of Parallel Imports available some help, is the so-called "Stones from other hills, can learn."The third chapter is the issue of parallel importation on a trademark situation, including the real situation and the legislative status quo. Only when we understand the situation in the case of such a situation can be made for coping strategies.Chapter IV is the bright spot as the place, the author summarizes the experience and understanding of various countries and regions on the basis of their status, on the mark on parallel imports of coping strategies provides legal advice and opinions, hopes to use the law of trademarks in parallel imports to a reasonable and effective regulation, can make faster and better our country’s economic and trade development.
