Abstract


\The subject aims to research, analysis, demonstration, for the minority areas of Gansu Province to further adapt to people's mediation system to provide theoretical support to enable countries to adapt laws and regulations in ethnic areas more suitable when the people, to love. Modern state under the rule of law on the national law and customary law conflict, the main ethnic and national minorities coordinated development of the legal system, there have been many famous scholars incisive research and discussion of legal workers grassroots creative work in practice also worthy of attention, but this aspect of the existing theoretical results is still relatively small. Mediation is a legal system with Chinese characteristics has been recognized by many developed countries and learn. Unfortunately, we are in the process of promoting the rule of law, but ignored the local legal resources of the excavation, blindly emphasized litigation universal, people's mediation gradually being diluted or even being marginalized. In this paper, the theory of dialectical materialism of Marx as a guide, the use of law, folklore, talent, statistics and other disciplines of the basic theories and methods, signed by domestic and foreign, and outside of people's mediation system, advanced practice, take the empirical analysis, quantitative analysis and the combination of qualitative analysis method to analyze the minority areas of Gansu Province People's Mediation System to adapt the current situation, problems and reform the way out. This paper is divided into seven chapters, one to four chapters using vertical linkages, horizontal comparison method argument to clarify the minority areas of Gansu Province People's Mediation System status quo and existing problems, the fifth chapter from the perspective of legal theory and folklore status and under the problems of feasibility analysis, sixth, seventh chapter combines ethnic minority areas of Gansu Province, people's mediation system is characterized by the applicability of proposed solutions.
