Abstract


In the law , how to deal with criminals , indicating that the developed degree of social civilization of a country with laws . The light punishment execution socialization trend of international development , and try to focus on punishment and education for the rehabilitation of offenders . Community corrections system as a social executioners , China for its long-term impact of traditional tion doctrine , full use of community resources to help complete the transformation of the offender to return to society . At the same time , slowing the pressure of prison , more reasonable allocation of judicial resources . Community correction system in Western countries are maturing , high usage rate , the effect is prominent in judicial practice has become an important means of Correction crime . Community correction system in China is still in the pilot stage , whether in legislation or in the theoretical research in a weak state , need a rich theoretical research to explain and enrich basis and support the need for legislation to provide long-term practice . In this paper, a comparative analysis of the theory with practical methods such as standing , law and sociology , community correction system to be step-by-step description and analysis , combined with China 's actual situation of the research study . Focuses on the problem of community correction system , including problems in the pilot phase of community corrections work , the problems exposed in the the Community Corrections native to promote the process , applicable to the main body of China 's community correction , the rules and regulations of the applicable objects exist problems and deficiencies. Community correction system in the development and current situation of the United States, Britain and Japan and other countries , put forward some proposals on this basis for the pilot phase of community corrections work reflects the legislative work of the Community Corrections . On community correction applies to the main body , the object of the provisions , including the reform of the current system of community corrections in clear judicial and administrative authorities as the implementation of the Community Corrections main , clearly the work of various departments convergence program , explicitly on the the corrected object of incentive appraisal standards , strengthen job security system, comprehensive protection measures , additional community service punishment . Gradually establish and improve the security system of community corrections legislation at the national level .
