Abstract


In this paper, a comparative analysis , empirical analysis , adopting both case studies and other research methods , briefly introduced the legislative background of the anti-dumping laws in the anti-circumvention system , examine the legal basis for its existence and legislative basis , the system of anti-circumvention legislation substantive rules and procedural rules , and summarizes the status quo of China 's anti-circumvention legislation , as well as constructive suggestions to improve China 's anti-circumvention legislation . In addition to the introduction and conclusion , is divided into five chapters: Chapter describes the background of the system of anti-dumping anti-circumvention problem . First -dumping , anti-dumping and circumvent anti-circumvention to analyze the background of the anti-circumvention measures the intrinsic link between the point of view of the social and historical reasons . Then the analysis of the anti-circumvention measures both positive and negative role as well as early relevant countries of the anti-circumvention practice . The second chapter analyzes the legitimacy of the anti-circumvention system , mainly to demonstrate the value of anti-circumvention system . First screwdriver case GATT attitude of anti-circumvention measures ; then start to analyze the legality of the anti-circumvention measures from the analysis of the legality of the anti-dumping regime ; from the anti-circumvention system with international direct investment and public interest principles of the anti-circumvention system to analyze the relationship between rationality . This is a focus of this article . Chapter study analyzed the evolution of anti-circumvention legislation in the European Union and the United States and its specific system , and the difference between the two at the comparison . This allows us to have a thorough understanding of the basic framework of the anti-circumvention system . This is another focus of this article . The fourth chapter analyzes the anti-circumvention provisions of the Dunkel text . Introduces the basic content of the anti-circumvention provisions of the Dunkel text this content evaluation , and then analyze the text ultimately not included in the reasons and the necessity to develop anti-circumvention law of the International Institute for the Unification of the WTO Anti-Dumping . The fifth chapter discusses the problem of China 's anti-circumvention system perfect . Analysis of the need for China 's anti-circumvention legislation Situation and Perfection discussed China 's anti-circumvention legislation should follow the principles and put forward China 's anti-circumvention specific system build envisaged .
