Abstract


Currently, during the process of social transition in our country, duty crime has become a serious problem that needs solution, its appearance and spread causing serious consequence to the development of the society. A more serious harm is done by the duty crimes committed by the prison policemen who work in judicial departments. They are analyzed according to the criminal law. By scope the duty crimes is mainly made up of execution and administrative surveillance while by nature they can be classified into corruption, misconduct and infringing upon personal rights. During the reform of the prison management system, prison departments have taken a series of measures to prevent and control the duty crimes, which has achieved certain effects as well as revealed many problems. The duty crimes committed by prison policemen are characterized by both diversification and regularity during their evolutive process. The reasons for these crimes are various, from macro to micro, from objective to subjective, from social to individual. On the basis of the comprehensive understanding of the reasons why policemen commit duty crimes, great importance should be attached to the concept, the principle and the aim of the fight against the duty crimes, which is vital to the study of the defense and control. Based on a comprehensive interpretation and deep understanding of the reasons why the police commit crimes, the study should be further promoted on the prison police’s crime prevention and control method. The method research should abide by such concept that the defense and control strategy should contain not only the reflection, the conclusion and the referential significance of the duty crimes committed in the past, but also the consideration on the mechanism, the system, the method and the structure in terms of the prospect of the development of the society and the trend of the duty crimes committed by prison policemen.
