Abstract


In recent years, restorative justice theory has been the gradual emergence of the criminal proceedings in our theoretical and practical judicial practice . However, compared with other countries , China's research on restorative justice and recognition is still in an early stage. Many scholars to explore the introduction of restorative justice issues are taking a very cautious approach, many scholars believe that restorative justice should be limited to the scope of juvenile delinquency , criminal negligence and some other areas of relatively minor criminal offenses , criminal felony field is basically a blank area , and even some scholars of restorative justice for a felony or a boycott attitude of the field . Investigated in recent years, popular in western countries restorative justice model and its development trend , I believe that will be part of the introduction of a special criminal felony for the promotion of restorative justice, victims' rights has great significance. The author first in domestic and international theory and practice of restorative justice to sort out the situation , based on the analysis of the introduction of restorative justice in criminal felony obstacles and resistance , noting that felony is the practice of restorative justice difficulties ; Subsequently, the criminal felony conduct type of analysis , pointing out that some of them have criminal felony restorative justice fit with particularity , this part of the introduction of a special criminal felony restorative justice is a feasibility and significance ; Finally, in a variety of existing recovery Comparative analysis of judicial use of the path , select the \By comparing analysis, case analysis and other methods of restorative justice in criminal felony and the relationship has been re- interpreted and discussed , try to break through the Chinese scholars advocated the introduction of restorative justice narrow range limit is proposed to selectively criminal felony of applicable restorative justice perspective , and strive for theoretical studies of restorative justice to make a useful exploration.
