Abstract


Less than a decade the rise and development of China as a new system of execution of punishment, community correction system is not the criminals and social isolation, and the use of community resources rehabilitation of offenders in the general term of the implementation of the system of non-custodial sentence, social progress , an important symbol of criminal policy increasingly rational, fair, humane and effective value, in line with reality and criminal policy scientific basis. Community Correction System by the crime of people living in a particular social environment posed by a variety of benign social relations, to impose a certain amount of relief, correction and rehabilitation measures and make them return to society to help the offender to re-adapt to normal social life is open, pay more attention to the transformation of the way of the effect of reconstruction is the concrete application of the concept of restorative justice in practice. Community Correction System tasks are: First, in accordance with the provisions of China's Criminal Law, Criminal Procedure Law and other relevant laws, rules and regulations, strengthen management and supervision, to ensure the smooth implementation of the penalty of Community Correction. Through various forms, to strengthen the ideological education of the community inmates, legal education, social ethics education, to correct the adverse psychological and behavioral, so that they repent and evil become good, law-abiding citizens. Third, is to help the community inmates to solve the difficulties and problems encountered in employment, livelihood, legal, psychological and other aspects, in order to facilitate the smooth adapt to social life. Western countries, the community correction system after nearly half a century of development has improved steadily and the legislation to judgment - convergence - execution - supervision and management - assessment of incentives - correction lifted links have a more complete system of Community Corrections has more than prison populations, and achieved good social benefits. Compared to some of the major foreign countries, the Community Rectification is still at an initial stage, the systems are not perfect imperfections, the most prominent: the recognition of community corrections, research and apply to be further improved; the Community Correction legalization is not yet high ; modern management tools use the lack of low-tech; management system that is not and so on. These are serious constraints to carry out the work of Community Corrections, must be reformed and perfected. In the process of construction and development of current and future community correction system, many problems need to strengthen the study and exploration, such as on Community Correction legislation, the question of form, the number of issues, jurisdictional issues, institutional issues, management issues, team building , the nature and evaluation of issues, we need to conscientiously sum up experience and lack of community correction work and build a complete legal system of community corrections, the scientific community corrections management system, strict management model community corrections, community corrections work to make this reform a steady and healthy development.
