Abstract


Community correction and enclose penalty are patterns of carrying out sentence. It is the important embodiment of socialization of carrying out sentence. Expanding the application has already become the development trend of the system of carrying out sentence in every country of the world. As an important issue in the criminal law, the research on the community correction is closely related to the legal system and legal concept. Whether its design is scientific and rational makes impact on the scientism and rationality of the whole criminal law. The community correction started late in our country. Its lack of application is caused by several aspects, such as the law making, the ideology and realization, and the improper operation of the process of community correction. So, a systematic and thorough study on this issue will have important theoretical and practical significance to probe into this area.This dissertation can be divided into five chapters except preface and conclusion.The first chapter begins with the definition and clearly analyses of the characteristics of community correction.The second chapter mainly deals with the origin of community correction, the development of community correction in foreign countries and the important value of the systems in community correction.The third chapter does research into the theoretical basis of the community correction system.The fourth chapter does research into the practice of the community correction system in our country.The fifth chapter begins with the practical significance of the reform of community correction system. Based on the practical significance, it puts forward the improvement plans in law rulings and systems in our country.
