Abstract


As a result of the development of market economy, social intermediary organizations emerged in a specified time of reform. Since the implementation of the policy of reform and opening, and with the deepening of the reform of economic and political system, governmental function has transformed from sectional and direct micro-management to indirect macro-management concerning industries. The role social intermediary organizations played in market administration evolved from immediate management to the opposite. The looser governmental administration becomes, the freer the market is, and the higher the extent of marketization of economic entities becomes. Social intermediary organizations play a role in mediating between the government and market to maintain a sound order of market.The first part of the thesis probes into the fundamentals of social intermediary organizations, and summarizes their features and functions, and elaborates on the analysis of the embodiment of in economic law. The social intermediary organization exerts its faculty in market-oriented economy system, so the thesis attributes the social intermediary organization to the entity in economic law, and take probes into the limitations of civil and administrative entities. The second part of the thesis focus on the rights and responsibilities of social intermediary organization and analyzes the rights and obligations from the point of view of the different status in economic activities, or rather the power as market administrators and obligations as market participators, strikingly embodying the feature of economic law combining the traits of public law and private law. The third part of the thesis is about the development and enlightenment of the legalization of the social intermediary organizations in foreign countries, where market-oriented economy is developed and social intermediary organizations are mature, so we can draw lessons from the mode of development and legislation. The fourth part analyzes the problems in the process of the development of our social intermediary organizations and tries to put forward some solutions.
