Abstract


The legal system of military administrative award, which is a vital part of military administrative legal system, plays an important role in inspiring people’s enthusiasm and creativity, improving the combat capability and promoting the construction of army and national defense. A perfect legal system of military administrative award is not only the base of propelling military administrative award but also the precondition for military administrative award in the background of rule of law in army. Currently, the domestic theory of legal system of military administrative award is undeveloped and there are a series of problems in the practice. So the legal system of military administrative award need to be improved both theoretically and practically. For this target, with the methods of literature search and investigation, the article views from military legal administration, begins with basic definition, and elaborates the difference between the legal system of military administrative award and common system, the effect of the legal system of military administrative award and the composing elements of military administrative legal relations. Based on theoretical research, the article tries to analyze, study and solve the problems in the aspects of history, current situation and future development. Firstly it reviews the history of legal system of military administrative award in our country and sums up its experience. Secondly it further analyzes the current situation of the legal system of military administrative award and points out its advantages and disadvantages. Finally, by means of combining the actual situation in China and the foreign countries’ experience, it puts forward some constructive suggestions for solving the problems existing in the system. The article does research systematically from the angle of military legality for the first time, builds a system for perfecting legal system of military administrative award and provides the practical researching thoughts and patterns to the military administrative award’s legalization.
