Abstract

China has a large population of 1,300,000,000.00,of which 700,000,000 are rural that connect the political system through more than 3 million village cadres include rural party organizations. Any inappropriate duty activities of these village cadres would possibly damage the benefit of those rural populations and intensify social contradictions. Petitions become more in recent years reflects the phenomenon of the existence of damaging peasants’benefits by village cadres, meanwhile, the channels, that peasants are in need for solving this contradictions, were blocked.In recent years, with the increase of the power on investigations on cases related with rural by inspection authorities, numbers of village cadres crime cases arise up with limited crime charges. Among these investigated cases of village cadres duty crime, one of the reason that occurs often is because there are some new crime area, and the other one is the exposing after the increasing power. It is not complex for village cadres crime, to compare with other normal duty crime, their methods are somehow simple and are less capable of anti reconnaissance, also characterized as more case connections and area gathering within villages. But the current law is limited on restricting village cadres’crime and the judicial is flaw that they cannot process legal supervise when the village cadres’administrative rights expand through implement of policies. That there is no method to deal with them when they are doing what ever they want leads the unfair of judicial, damages the solemnity. Because of the close connections between the village cadres and peasants, the phenomenon of the village cadres’out of punishments shows to peasants directly intensifies the trust crisis of basic level judicial works and increase the unsatisfaction of social policy, which is the reason for peasants get over the basic level, take petitions to tell their requirements. In current years, our country is deepening rural reform, coordinating rural developments. It is not a new topic of rural basic level duty crime, it is because it needs to be paid more attentions that the gathering of rural duty crimes delivers a signal that wrong value is influencing rural deeply, construction of virtue is lagged. This is not benefiting the new rural constructions. We need to take positive methods to prevent and decrease rural duty crime, with pragmatic and scientific attitude, according to its requirement for developing, to be realistic, to built a rural duty crime prevention system that fits rural basic character and requirement, to promote the construction of new rural harmonious society.This article gives us survey on rural basic level organization officers’duty crime based on recent years investigated cases related with peasants, from its expression and character, analyzed those crime phenomenon, and raised some methods of rural duty crime prevention.
