Abstract


Online bank is the traditional financial industry with modern information network technology, combined to form a new financial shape, since 1995, the first 10 months of the internet banking, security is the first internet banking (sfnb) in the united states since its inception, the growth has soared.internet banking service for its convenience, promptness, low cost, performance, the more characteristics of a great convenience and benefits to the bank bring in new growth point, but also create new legal problems and risks.In china, first launched in 1997 china merchants bank on the financial services:"a network through——the online payment", then the bank of china, industrial and commercial bank, construction bank, the communication bank, agricultural bank everbright bank and the big banks are to achieve "banking" of pace. China’s internet banking regulatory legislation since the beginning of this century has just begun, and subsequent promulgation of the electronic signatures ", the internet banking for business management of the provisional measures, the electronic banking regulations and other relevant laws and regulations, a certain extent reduce the internet banking supervision over law of the problem, but compared with foreign countries, there are legal supervision system are not strong enough, the value orientation is not clear, the relationship between rights and obligations can’t wait to be desired.This article is based on domestic, in brief introduction on the basis of the bank and its characteristics of china, the internet banking in the face of all kinds of risks, our banking supervisory legal system and issues, and by analyzing the examples overseas experience and improve our legal system of banking supervision of the proposed.
