Abstract


Financing has been a common challenge faced by the SMEs worldwide. The attacks of the global financial crisis, exacerbated by financing difficulties of SMEs in China, China's SMEs are facing the biggest test of survival in the 30 years of reform and opening up. In view of the important role of SMEs in the national economy, how to overcome difficulties in financing to support the healthy development of SMEs, and has become an important topic of the relationship between the national economy and the people's livelihood. Credit guarantee perfect credit guarantee legal system as a bridge and link of contact between banks and SMEs, the breakthrough to solve the financing problems of SMEs in China, has a vital significance in resolving the plight of SME financing. By comparison of the legal systems of the developed countries, credit guarantees, analyzed and summarized the achievements and shortcomings of the legal system of China's SME credit guarantee, for lack of a number of recommendations to improve the SME credit guarantee legal system, in hopes of SME financing The plight solution provide support and help on the legal level. This paper is divided into four main parts are discussed: an overview of the SME credit guarantee. This section describes the background, literature review, research significance, and creative SWOT analysis of their own advantages and disadvantages sized Enterprises internal external factors as well as small and medium enterprises, and pointed out that the credit guarantee is an inevitable choice to solve the financing difficulties. Second, the status quo of the legal system of China's SME credit guarantee and inadequate. Analysis to identify inadequacies in the absence of special legislation, such as SME credit guarantee, the lack of regulatory legislation, risk prevention control system is imperfect and other issues. Comparative Study of SME credit guarantee legal system.
