Abstract


\China's criminal law and judicial interpretation Although more detailed provisions on the subject of a crime of Bribery class , but in the face of a very complex social reality , these provisions are still not specific enough and clear in the judicial practice on the identification of the main crime of Bribery class there is some controversy. Author from the point of view of the judicial practice , to do in Silver City, 2005-2009 by corruption and bribery cases criminal subject identified research focus from Baiyin City Attorney agencies investigating cases of corruption and bribery investigation and handling of the status quo , do the cases in the main aspects comprehensive analysis of the characteristics the main identified some specific aspects of the practice , handling cases difficult and vague understanding of the main body of this kind of crime , focusing on the state-owned holding , management of shareholding enterprises , state-owned units assigned to non- engaged in official business of the state-owned units , the other engaged in official business in accordance with the law under what circumstances meet the prescribed requirements of the national staff discusses cf the relevant provisions of the United Nations Convention against Corruption \inadequacies in the national staff provides on future judicial practice how to accurately grasp the national staff to make a few envisaged .
