Abstract


According to the provisions of Article 31 of the foreigners in the People's Republic of China on Entry and Exit Administration Law \nationality . Foreigners in the sense of criminal law can be divided into two categories: First, the foreigners who enjoy diplomatic privileges and immunities ; does not enjoy diplomatic privileges and immunities of foreigners in general . According to China's Criminal Law Article 6 , Article 11 of the relevant provisions of foreigners in general, our country , for the crime in our country has criminal jurisdiction applies to China 's \Discussed in this article general of foreign nationality not have Chinese nationality , foreigners do not enjoy diplomatic privileges and immunities of foreign nationality . Probation as a penalty , China 's \But based on our probation system itself is not perfect , but foreign people in general different from the Chinese citizens in the different characteristics of nationality , of the Penal Code or related laws and regulations are not clearly defined , in practical work for the average foreign person probation application and inspection , there are many difficulties and problems . The author argues for foreign people in general to be used with caution in probation for foreign people in general different from the Chinese citizens in different nationality produce different in real life , in addition to China 's existing Criminal Code provisions applicable conditions of probation , characteristics , should be substantive conditions of probation applicable supplementary refinement , the practical problems of application and study of foreign probation at the same time analyzing and corresponding countermeasures , which aims to continuously improve the foreign people in general application of the probation and study related systems to promote suspended for the effective implementation of , and truly reflects the positive role of the probation .
