Abstract


Drink driving , drunk driving is one of the important risk factors that lead to traffic accidents . In recent years, such cases showing rapid growth . How to effectively curb drink-driving and drunken driving , the most effective solution is to drink driving incrimination . This article discusses the lack of drink driving current law , especially of repeated criminal sanctions defects in drink driving . Of drink driving the judicial precedents examine , learn from foreign and Hong Kong, drink driving incriminating legislative practice , the need to clarify our country to punish drinking and driving should be separate legislation , put forward legislative proposals of drinking and driving offenses , and specific application of the guidance .
