Abstract


Institutional transition and social transformation in the new situation, China’s juvenile crime rate is increasing year by year. As the number of juvenile criminal cases accounted for an increasing proportion of the total number of criminal cases involving high, therefore, how to effectively prevent and reduce juvenile crime has become an urgent social problem.Prevention of juvenile delinquency is much more than a "Prevention of Juvenile Delinquency," can be solved, in the prevention of juvenile delinquency in the legal system and work areas, the legislative branch, the judiciary and government departments must play their part, can play an active role in coordination, the real interests of the protection of minors to play in preventing and controlling the effects of juvenile delinquency.This article on how to build an adaptive and effective and orderly to prevent juvenile delinquency study the legal system. Through comprehensive analysis of domestic and foreign use and juvenile justice system and education on the management concept and practice of both the work of the results of comparative analysis of China in the prevention of juvenile crime and its causes exist in the absence of proposed economic and social development in China adapt the law to prevent juvenile delinquency patterns of Law. This article is divided into four chapters:The first chapter introduces the juvenile delinquency and juvenile legal concepts related to the physiological and psychological characteristics, analyzes the characteristics of juvenile delinquency and the reasons for building a comprehensive legal system to prevent juvenile delinquency provides a theoretical basis.The second chapter describes the typical two legal systems of the world countries and regions of Hong Kong, Macao in the prevention of juvenile delinquency in the justice system and working mode of the main features of the Perfection of its law to prevent juvenile crime reference model value.The third chapter of our current legal system to prevent minors were analyzed, and the prevention of juvenile delinquency system of the expense of the legal protection of the rights for adults, is thinking of starting only from a single criminal law legal system, general and lack of maneuverability, can not really play an effective prevention of the fundamental purpose of juvenile delinquency.Chapter four main issues outlined in the previous chapter, to be effective in preventing juvenile delinquency in China made a number of legal thinking and discusses the rights and interests in the protection of minors, prevention of juvenile delinquency in the legislative, judicial and governmental responsibility, etc. suggestions for improvement.
