Abstract


The aura of the rapid economic development can not hide the reality of the deterioration of the environment . In the under development model in the world today , environmental protection and economic development model has become inevitable and must closely integrate . Environmental legislation in its significance and role in as limiting environmental crime , the most effective means of protecting the environment , not only because the constraints but also because crime alerts and deterrence . Requirements of the type of environmental crime needs to have a clear hierarchy and well-organized , to the general public fully understand and accept . The environmental crime typed is divided into several types of environmental crimes in accordance with a standard , make a clean break from each other boundaries , propose targeted law applicable rules . The environmental crime typed contribute to a better understanding and prevention of environmental crime , increase emphasis on environmental crime . This paper attempts to research the type of environmental crime , organize and establish reasonable environmental crime by type , the status quo of domestic and international environmental crime legislation . This article in the Introduction and five body part structure : Introduction . As the opening of the article , a brief introduction to research methods in environmental criminal background issues , articles , necessary the bedding and analysis of the premise behind . The first part is first summarized overview of environmental crime that introduced the concept of environmental crime and environmental crime typed introduced . The second part of the civil law countries and common law countries , environmental crime legislation , summarizes the corresponding national environmental crime system , provides the basis for later analysis learn . The third section describes our type of environmental crime legislation provides that the provisions of the Criminal Law on Crime' dissertation">Environmental Crimes typed and our academic understanding of the types of environmental crime . The fourth part is the focus of this article , first of all based on the status quo of China 's environmental legislation by our current legislation on environmental crime type defects , and then classified two perspectives on environmental crime type performance from the patterns of crime and criminal behavior . The fifth part is the last section of the article summarized .
