Abstract

The crime of illicit trade is set in 1997. Because the criminal law used the special blank indictment for the illegal management crime to describe the crime, this enabled our country illegal management crime to have the high concise quality and the uncertainty, has caused the illegal management crime unceasing expansion. Since the crime of illicit trade set, The National People’s Congress, the Standing Committee of the National People’s Congress, the Supreme People’s Court and the Supreme People’s Procurator ate have successively promulgated a series of supplement provisions and judicial interpretation about it. Linking with the crime of illicit trade being magnified in our country’s judicial practice,the crime of illicit trade has became a crime with most changes after revision of the Law of Crime in 1997 . Therefore, The judiciary should be a high degree of attention to the issue of illegal expansion of the crime.
