Abstract


With the rapid development of economy and technology, constantly updated , the world pay more attention to the protection of consumer rights . As a special consumer protection policy , consumer cooling-off system has been in some foreign legislation required by law, and to become a legislative trends . In our country , \, origin , nature and their national legislative practice to start, focus on revealing the content of the system , and with our current laws related to similar systems were compared ; second part theory, cooling-off period for the consumer system established providing legal support ; third part , based on China's actual conditions , discusses consumer cooling-off period system in China to build the necessity and feasibility ; fourth part , drawing on experience in national legislation based on the proposed cooling-off period of the system to build consumer legislative model and specific content , and concluded that the phenomenon of consumer fraud in our country seriously disadvantaged consumers more pronounced in the case , as the cooling-off period to consumers tilt system established in the law of comparative advantage in shaping the consumer to balance its inherent disadvantages in practice , to better protect the interests of consumers. However, the establishment of this system is the traditional theory of contract law a major impact , it applies also inevitably bring about a series of negative effects, such as operators increased transaction costs , etc. Therefore, our consumption of cooling-off period in the build system should face its possible adverse effects , to be actively guide and adjust and improve relevant laws and support mechanisms , the legal system in order to achieve mutual convergence .
