Abstract


Food safety is closely related to our life.At present, in the global scope increasingly frequent food safety problems, and led to many of the whole society, will be how to guarantee food safety forward-edge position, food safety has become a worldwide topic. In our country, "the melamine powder event" and other concerned range, the social effects of the strong, led to the attention of food safety.Therefore, the Chinese government attaches great importance, unceasingly strengthens the food safety legislation, straighten out the supervision and administration departments of law enforcement responsibility, establish food safety pre-warning mechanism for the protection of consumers, and set up legal barriers to food safety, provide the system safeguard. However in the food safety within the field of consumer rights and interests maintenance are still exist many problems, such as, food safety detection technology and inspection agencies in the food safety testing and safeguard the ability, The protection of consumers’ rights and interests of the content and the social reality of adaptability, consumers’ food safety problems encountered after the difficult question, consumer groups in maintaining the rights and interests of consumers, these problems function restriction of food safety problems of the protection of consumer rights and interests of the important factors.Therefore, this article expounds four parts:The first part for food safety, introduces the concept of food safety and food safety, and legal construction of China’s food safety situation around in food safety problems.The second part of our food safety protection of consumer rights and interests of the field are analyzed, and the main introduces the safety of food and consumer society for the protection of consumer rights and interests, and the important role, and combining with actual, the protection of consumers’ rights and interests in the food safety problems in maintaining the problems existing in the consumers’ rights and interests.The third part mainly introduced in Germany, the United States and Japan in consumer organization construction and function division, testing setups and functions, consumers’ rights and interests, and the judicial protection for China to win the protection of consumers’ rights and interests can be used for reference.The fourth part is in the front, based on the analysis of the problems of how to better protect consumers’ rights and interests in the field of food safety, bring forward comments and Suggestions. Including the protection of consumers’ rights and interests of the perfect, food safety supervision, strengthen the food safety monitoring and supervision by public opinion, cultivating idea of rule aspects elaborates.
