Abstract


Consumers' right to information is an important element of consumer rights is fundamental rights. Consumers' right to know whether or not directly related to the realization of the right to consumer safety, freedom of choice, degree of realization of the right to fair trade. Today, e-commerce, that is, people in the eyes of the \However, e-commerce is not face to face transactions, and the network has a virtual, technical and other characteristics, which makes the weak position of consumers in electronic commerce more obvious, more difficult to achieve the consumer's right to know. However, e-commerce in the modern business is becoming increasingly important, transaction volume is growing rapidly. Therefore, how to adequately protect consumers' right to information in electronic commerce law worker is placed in front of us is an important topic. This body part by four chapters. The first chapter is on consumer e-commerce consumers' right to know and the basic theory and background knowledge. I focus on the concepts from the consumer's right to know, connotation, legal meaning of basic theory, through the analysis of e-commerce consumers 'right to legal requirements, that e-commerce consumers' right to know consumers compared with the traditional has a much more broad, more susceptible to damage, change in the way the exercise of particularity. The second chapter is on foreign commerce in the case of consumers' right to introduce legislation. The author used the comparison method, the major countries of foreign commerce in a wide range of consumers' right legislation and comprehensive introduction and study. Learning foreign-related legal system, e-commerce in our country to protect consumers' right to have referential significance. The third chapter is on China's e-commerce consumers' right to legislate Analysis. China is not specifically for e-commerce in the consumer's right to know the relevant provisions of the consumer's right to know about the traditional legislative scattered in many laws and regulations, there is no system. The author lists and analysis of relevant legislation, analysis of the current legal provisions exist in our inadequacies, so as to seek Chapter measures to improve the system provides the basis. The fourth chapter is how to improve our e-commerce consumers' right protection system is the focus of this article. Through the analysis of Chapter III, the author found in our legislation, there are some unreasonable, but also to the practice of e-commerce consumers' right protection inconvenience. Thus, for the problems in the existing system, the author proposes a comprehensive system of e-commerce consumers' right to know a number of recommendations, which are discussed mainly from the legislative level, such as: enhanced operator information disclosure obligations; clear Internet trading platform provider liability; regulation of online advertising. Protection of consumer interests in electronic commerce concern, also a lot of related articles. However, most of the articles in the major consumer e-commerce for the study of the nine rights, right to information on e-commerce consumers mostly in passing. I choose to e-commerce perspective to study consumer's right to know, is conducive to a thorough study of this system. Features full text of this article is to focus on the operators of the three information disclosure obligations content - the operator's own disclosure of information, goods or services, information disclosure and trading conditions for the disclosure of information by comparing the foreign legislation and legislation concerning the content of the different regulations, practices and systems analysis problems, how to improve our e-commerce system of protection of consumers' right to put forward some suggestions for the author.
