Abstract

Computer crime is accompanied by the invention of computers and the Internet and applications to produce a new type of crime , compared with the conventional crime , the criminal means , crime and other aspects of the object there is a big difference. As computer hardware and software technology and the rapid development of the Internet , computer crime also showed rapid growth. 1997 new criminal code amendments promptly increase the content of computer crime , the crime however刑法理论界concepts constitute a crime , there are still a lot of controversy . This paper attempts to criminal law point of view , the reason for computer crime , concepts , components and other aspects of research, and the Perfection of the Crime issue a preliminary study . Thesis is divided into five chapters: The first chapter is computer crime overview. Discusses two issues, both at home and abroad from the first sort out the context of the development of computer crime generates and analyzes the future of computer crime may exhibit new trends ; then momentum on computer crime , the reasons for the intensified analysis . The second chapter discusses the concept of computer crime . First introduced the concept of computer crime at home and abroad on various theories and make comments ; and then propose the concept of the definition of computer crime ; later on and computer -related crime , easy to confuse the concept of a distinction. The third chapter discusses the characteristics of the computer crime . Includes two aspects , one is the phenomenon that computer crime computer crime characteristics, two constituent features of computer crime is that the subject of crime , crime subjective aspect , criminal object , objective aspect of crime four elements , each an element in the analysis of controversial issues were highlighted . Chapter IV describes the foreign criminal legislation against computer crime situation and a brief analysis . Chapter V discusses our criminal legislation against computer crime provisions and improved. Divided into two parts , first introduced legislation on computer crime of criminal provisions , and then focuses on analysis of computer crime legislation need to be perfected and made the author's recommendations.
