Abstract


Digital content industry, as an important economic growth point, has created a huge economic value as well as employment opportunities. In the year 2009, the scale of China’s digital content industry has reached 536.8 billion Yuan. China’s relevant departments have also given more and more strategic positioning to digital content industry. Digital content industry, as an important part of the information society, has been one of the most important parts for China’s "2006 to 2020 national development strategy”.With the rapid development of internet technology, the swift spread of digital content products on a global scale has become a reality, which has greatly enriched people’s life. Despite the fact that it has brought great conveniences to the public, at the same time, there are a lot of illegal downloading behaviors which are serious violations of the rights and have caused tremendous economic losses for copyright owners.The problem of infringement for Digital content downloaded from the Internet is particularly serious in China. In the internet environment, many kinds of digital resources can be accessed without any payment to copyright owners. As a result, it has greatly reduced the digital content creation initiative and hindered the development of the digital content industry. On December 11th 2001, China joined the WTO, and on March 6th 2007 China’s accession to "the WIPO Copyright Treaty" and "WIPO Performances and Phonograms Treaty." Therefore , how to integrate with the international copyright protection is an urgent problem in China. although China has made corresponding amendments to the copyright law to meet the WTO "Agreement on Trade-Related Intellectual Property Rights" and the two Conventions of the World Intellectual Property Organization, but there is still a certain gap from the international Copyright Protection in the internet environment. In recent years, China has been the target for infringement accusations for illegal download from the internet. Therefore, how to improve the internet environment under the two treaties of both the WTO and WIPO Internet is an urgent problem.The first chapter introduces the characteristics of digital content products, content and Internet download. The second chapter describes the foreign digital content downloaded from the Internet-related legislation, and analyzes characteristics of the foreign legislation. The third chapter analyzes the digital content downloaded from the Internet and the connection with the copyright, and describes the current methods to download copyright though the Internet and the infringement against the copyright owner. Chapter IV analyzes the current lack of legislation and, according to the actual situation, proposes some recommendations of fighting against the violations associated with the current digital content downloaded from the Internet
