Abstract

Nowadays,the widespread existence of restricted competitive behavior by public-service corporation in China depending on its advantages in the markets has brought about many dangers.It not only do a great damage to the legitimate rights and interests of other business operators and consumers and the fair competition order of markets,but also hampers the improvement of its own development and competitive abilities.What’s worse,it damages the image of government to some extent.The cause lies in many factors,one of which is the weak punishment of civil liability imposed on the restricted competitive behavior.Nowadays,the adjustment to restricted competitive behavior of public-service corporation is according to the Laws Against Irregular Competitive.However,the regulations on civil liability have not been improved, for instance,it is hard to confirm and punish some of the dangerous behaviors owing to the weak regulations on the limits to the restricted competitive behavior of the public-service corporation .On the other hand,the unsuitable liability borne by the restricted competitive behavior cannot curb the birth of that behavior,or defend the fair of competition order in markets or protect other business operators and consumers,legitimate rights and interests.It is necessary to improve the civil liability of the restricted competitive behavior of public-service corporations.This article discusses the concept, constitution conditions and types of the
