Abstract


This paper discusses the Road Traffic Accident Compensation Principle of social concern, and this has been a hot topic of debate in various circles , the author from the traditional principles of tort Liability and legal characteristics of the theoretical basis of the perspective , combined with home and abroad on the principle of road accident Compensation legislation and comparison of the evolution of the world's countries to solve this problem is a common practice to review our current laws concerning motor vehicle and non-motor vehicles , road accidents between pedestrians the liability of principle, clearly our current law is adopted incomplete principle of liability without fault , and from a theoretical and practical point of view of justice , and further analysis of the current road traffic accidents in China should implement fault this tort presumption of imputation method , the last of a clear and standardized responsibility principle of presumption of fault and improve relevant laws and regulations and the establishment and improvement of road traffic accidents and liability for damages ancillary insurance system to make their own modest opinion .
