Abstract


Along with the continuous development and improvement of China's market economic order, China's accession to the WTO, the international economic exchanges increasingly frequent and gradually return to the foreign-related economic laws of Hong Kong, Macao, and Taiwan, the expected conflict will show an upward trend. In handling foreign conflict disputes, rational use of private international law, the Public Order Reservation System, the conflict will be resolved in a reasonable, play an active and important role in maintenance of the independence of the judiciary and the authority of the law. Throughout the legal construction of the new China, China identified Reservation of Public Order, legislative and judicial practice, there are certain shortcomings and defects. Therefore, this paper aims to backtrack on the basis of the origin and development of the Public Order Reservation System, summarize the pros and cons, to explore its application in China and improve. This paper is divided into five parts, discusses the basic connotation of public order, historical development, Public Order Reservation System in China's legislative framework and judicial practice, lack of system and improvement of public order reserved specifically address China's Interregional Conflict of Laws reservation of public order in the case of the use of problem. The first part of the article aims of public order regime of reservations for a basic definition, a brief introduction to public order reservations system from three aspects of the meaning of the role of its legislative mode.
