Abstract


How to build a personal information protection system has been a hot issue in the study of theory, our research has developed rapidly despite a late start, however, Professor and Professor Zhou Hanhua Models from the proposed draft of the introduction of two experts, research in this area in our country has maturedsign.In the expert advice based on the draft in line with our national conditions and this article attempts to explore the personal information protection systems, a comprehensive analysis of the extraterritorial personal information protection mode, I tend to follow the U.S."safe harbor model" to design a personal information protection system of China, this system not only has specialized in the "Personal Information Protection Act,"a large number of industry practices will be introduced to the structure of protection of personal information which, so to maximize the play all social forces to build our web of protection of personal information.To illustrate this problem, several aspects from the following discussion.The second chapter focuses on the relevant countries and regions as regards the protection of personal information, legal requirements of the United States and the European Union focused on the legislative situation, the introduction by Zheyibufen, showing a worldwide on this issue within the theory and practice of Cheng Guobetter to discard the dross its essence, so for our own use.The third chapter analyzes the status of our personal information protection, through several real-life examples reveal the existence of China is a serious infringement of the status of personal information.China’s current situation against the personal information have been very serious, there are many reports related to,but China is relatively weak legal protection and social development in calling our legal system to protect personal information, the rapid development and improvement.The fourth chapter is the focus of this article, and innovations, on the protection of personal information protection mode, the two experts were unanimous in the recommendations of the adopted draft model legislation, but I think that model,while legislation in line with our tradition of civil law countriesHowever, a law alone is difficult to cope with the expansion of personal information against the status quo, and related industries should be absorbed in, full use of its industry norms and industry practices self-discipline, so as the legal construction of additional and better information from individualsprotection system
