Abstract

Human over-exploitation, causing a huge impact on the marine environment and resources, and even vicious impact. With the gradual transition of human values ??and ethical orientation, rational development and conservation of marine resources and the environment has become an inevitable trend. Marine Nature Reserve as an important way to protect the marine environment and biological resources, protection of special marine rare and endangered species and their habitats, and widespread concern by the international community. Relevant country has established a number of marine nature reserves, to speed up the process of legal protection of the protected areas, and to improve the quality of the construction and management. Relatively complete legal protection of marine nature reserves in the developed world, and to promote the development of protected areas in the country. Accumulated in the legal protection of the protected area, the United States, Canada, Australia, effective experience enacted special laws and regulations of the protected area system of protected areas legislation and hierarchical, in the protected areas, the construction process of the implementation of the alternative, screening, and evaluation systems reasonable, overall planning layout. Hierarchical management system at the same time transparent and efficient implementation of effective oversight mechanisms capital protection mechanism to form the complete management of the legal system. Construction of marine nature reserves in China started late, protected areas legislation is not yet ripe, the number of protected areas and regulations promulgated by the small, low effectiveness level. Protected areas in the building did not form a complete planning system, and the legal systems of public oversight and public participation in protected area management has not yet been established, therefore, the legal protection of the protected areas in China there are still inadequacies. In this paper, the theory and practice of the legal protection of foreign marine nature reserve, on the legal protection of the marine nature reserves in China to offer constructive ideas. To learn foreign protection zones proceedings proposed alternative screening - evaluation system of protected areas in the establishment should take; our country protected area management, the implementation of the \Marine Nature Reserve legislation to build, promote integrity and development of the legal protection of marine nature reserves in China. This dissertation includes the following six sections: Summary of the first part of the legal protection of the marine nature reserves, nature reserves, marine nature reserves, marine protected areas, a comparative analysis to define the concept of marine nature reserves. From the many ways to explore the need for legal protection of marine nature reserves provide a theoretical basis for the study of marine nature reserves. The second part of the study the legislative history of the marine nature reserves as well as the status quo, and the international community, the legislative history and the current situation in the United States, Canada, and Australia to study, proposed marine nature reserves abroad legislative system characteristics and provide a reference for our legislation. The third part of the legal protection of marine nature reserves in the establishment of a planning study, the establishment of protected areas by analyzing the foreign institutions, the establishment of the proceedings, planning legal system, the establishment of alternative screening system proposed marine nature reserves need to establish the reserve system and overall planning system, and reasonable resource utilization and configuration to avoid the many problems of the protected areas established. The fourth part of the analysis of the legal system of the foreign protected areas management system, management system of financial input, multi-functional partition the system proposed Marine Nature Reserve horizontally and the longitudinal coordinated management system, the special zoning management, to prevent the repeated multi-agency management. Part V of marine nature reserves in China as well as legislative, planning and management analysis of the legal system, the proposed legislative system of protected areas imperfect, the overall set up the planning and layout of the irrational, chaotic management system, management system is not perfect . Part VI of Marine Nature Reserves, corresponding suggestions and countermeasures to improve marine nature reserves in China, including the principles of clear legislative guidance, a sound legal system, improve protected area management system and improve the protection zone set up the planning system and management of the legal system, and actively participate in international cooperation.
