Abstract


The economic formations have undergone tremendous changes in Song Dynasty compared with previous dynasties. Especially the lifeblood of the small-scale peasant economy---land has a major change:private ownership of land takes the leading role. The government of Song Dynasty strengthened the management of land ownership and its derivative rights. As a result, corresponding laws and regulations emerged so as to keep up with the requirement of the development of productive forces and the transformation of the socioeconomic structure. The paper consists of 3 parts:Introduction, Main body and Conclusions. The main body includes 3 parts.Chapterl:The prosperity of commodity economy in Song Dynasty facilitates the frequencies of land transaction, during which land ownership, usufructs and security interest have achieved an unprecedented development. Starting from legislation, the government of Song Dynasty formulated more comprehensive and detailed laws and regulations in the hope of protecting the land ownership and its derivative rights.Chapter2:From the aspects of land ownership, usufructs and security interest, this chapter makes specific analysis of the civil cases taken from The Collection of Judgements Made by Feudal Bureaucracies in Partically in Song Dynasty which can reflect the previous three rights. Meanwhile, a comparative analysis is also adopted based on the content and principles of modern Property Law.Chapter3:This chapter consists of both the positive and negative experience of the legal systems of land management from the government of Song Dynasty. The positive experience is mainly from the aspects of substantive law and procedural law, indicating the standardization and systematization reflected in handling land rights disputes on the part of the government of Song Dynasty. The negative experience mainly analyzes the land policy undertaken by the government of Song Dynasty, whereby some implications for land conflicts in the modern society are drawn.
